Spouse and family visa

UK Family Visas allow eligible foreign nationals to reunite with their family members in the UK for extended stays of 6 months or longer. At Cromwell Wilkes, we specialise in family visa applications, providing expert advice and support for those looking to reunite with family members in the UK. If you’re looking to join family members in the UK and you’re from a non-EU or EFTA country, you may be eligible to apply for a UK family visa. This includes: Spouse, fiancé(e), civil or unmarried partner of a qualified sponsor Children under the age of 18 Parent of a child under 18 Individuals seeking to be cared for by a family member in the UK TYPES OF UK FAMILY VISAS SPOUSE VISASPOUSE VISA The Spouse Visa is for those wishing to join their British or settled partner in the UK. To qualify for a Spouse Visa, both you and your partner must be aged 18 or over and meet the following criteria: You both must intend to live together permanently in the UK. The sponsor (your partner) must be earning at least £18,600 per year before tax. You must have a good command of the English language. One of you must be British, Irish, settled in the UK, or from the EU with pre-settled status (if you arrived before January 1, 2021). You must be able to provide proof of your relationship, such as marriage certificates or evidence of cohabitation. To qualify, you must meet the following requirements: You must be at least 17 years old. You must be a Commonwealth citizen or a British Overseas Citizen. SKILLED WORKER VISA

The Skilled Worker Visa UK allows skilled international workers to secure employment with licensed UK employers. Applicants must obtain a valid job offer, receive a Certificate of Sponsorship, satisfy salary and language requirements, and submit an online application. NEW RULES FOR THE UK SKILLED WORKER VISA From 4 April 2024, the minimum salary requirement for the Skilled Worker Visa increased to £38,700 per year or the job’s going rate, whichever is higher. The UK Government’s 2025 Immigration White Paper outlines several significant proposed changes to the Skilled Worker visa route. The UK Skilled Worker Visa allows international talent with eligible skills (RQF Level 3 and above) to live and work in the UK for licensed employers. This visa replaced the Tier 2 visa at the end of 2020. After five years, it offers a route to permanent settlement (ILR), provided all eligibility criteria are met. WHO CAN APPLY FOR THE SKILLED WORKER VISA UK? You can apply if you: Have a valid job offer from an approved UK employer. Receive a Certificate of Sponsorship (CoS). Meet the minimum salary requirements (£38,700 or the job’s going rate). Have sufficient English language skills (CEFR Level B1 or above). Have at least £1,270 to support yourself. RICHARD ROBERTS

LEGAL DIRECTOR

Richard was called to the Bar (Middle Temple) in 1999 and started his legal career as a pupil barrister in criminal law before specialising in Immigration and Asylum law from 2001.

Before establishing Cromwell Wilkes in 2013 he worked for a national legal advice charity, as an in-house appeals advocate for a firm of London solicitors, and as legal advisor and appeals advocate at a West London law centre. He also offered pro bono legal advice and assistance to the organisation ‘Fair Trials Abroad’ in cases concerning British Citizens imprisoned overseas.

As Legal Director at Cromwell Wilkes he is regulated by the Immigration Advice Authority (IAA) at the highest level and is a graduate member of the Chartered Institute of Legal Executives. He is also a qualified legal trainer. He is a respected expert in all aspects of UK Immigration Law but now focuses predominantly on commercial and business immigration, deportation cases, and appeal work.

In addition to Immigration and Human Rights law, he has long experience in matters of private and commercial contracts, Employment Law, company formation and corporate responsibility.
He holds a master’s degree (LLM with Distinction) in International Sports Law and has particular interest in representation before the Regulatory Commission and Appeal Boards of the English Football Association including Rule K Arbitrations. He can however offer representation to any professional or amateur sportsperson in contractual or disciplinary matters, whether before the UK domestic sporting tribunals, the Court of Arbitration for Sport in Switzerland (CAS), or the UK National Anti-Doping Panel.


Richard has previously provided expert evidence to the High Court of England and Wales (Family Division) on domestic violence law within an immigration context and has also acted as an expert witness on UK Immigration Law before the Court of Appeal for Ontario in Canada.
Since 2008, as an appeals advocate, he has appeared regularly before the First Tier and Upper Tribunals in matters ranging from complex family migration, European Union and post-Brexit law, asylum and protection, human trafficking and modern slavery, LGBTQ and religious freedom cases, and deportation appeals. As an advocate he has been described as a “cross between George Carman and Christopher Hitchens”.


He is a member of the Immigration Law Practitioners’ Association, the International Law Association, and the British Association for Sport and Law. He is also a member of the Royal Society of Literature, and his wider academic interests lie in European literary and classical studies. He lives in West London and is a long-time multiple season-ticket holder at Fulham Football Club from where he follows his beloved team home and away.

LUCY WHITMER

Operations Director

From Pennsylvania, USA, Lucy is a First-Class graduate in Law with Art History from Northeastern University London. After joining Cromwell Wilkes in early 2025, she was quickly appointed Operations Director, while simultaneously training to be an Immigration and Asylum Caseworker. She has a particular interest in asylum and human rights cases, including deportations. Outside of work she enjoys creating music, travelling, and mountain biking back in her home country.

Trainee immigration and asylum caseworker

Sadia is a graduate in law from City University and also holds an LLM degree specialising in human rights. She completed her Bar Vocational Studies in 2025 and plans to practice as a barrister. She has a particular interest in family and complex human rights cases, deportation, appeal work and challenging negative decisions through early stage interventions. Away from work, she enjoys walking, shopping and cooking.

Immigration

Christine Bacon is accredited to provide immigration advice and casework to IAA Level 2 and is working towards Level 3 accreditation. She also holds an MSc in Forced Migration from the University of Oxford. She has a particular interest in family and human rights cases. Christine also works as a playwright, theatre maker and podcaster. She is originally from Australia and, as such, has a completely stereotypical obsession with the quality of her daily coffee.
